Overview

 

POSITION SUMMARY:

The Bankruptcy Specialist Sr. is responsible for timely processing of bankruptcy items regarding a borrower’s home mortgage. The Specialist will file Proof of Claims, and Reaffirmation Agreements with the court, perform monthly audits of bankruptcy cases, process payments received on bankruptcy accounts, review accounts for potential legal action, and monitor all loans referred to our attorneys for Relief from Stay. The Bankruptcy Specialist must be able to communicate effectively with the General Counsel representing Rushmore, as well as Counsel for the party that is involved in the active bankruptcy. Team Lead will assist Supervisor in auditing and defining and executing procedures.

 

Responsibilities

ESSENTIAL DUTIES AND RESPONSIBILITIES:

  • Update LPS workstation when Bankruptcy petition is received and activate it in MSP.
  • Complete full audit on all acquisition loans by reviewing prior servicer loan history, notes, payment posting, BK Trustee ledgers and Chapter 13 BK plan.
  • Refer new Bankruptcy cases to attorneys.
  • Review Proof of Claim figures to be filed the Bankruptcy Court.
  • Review Chapter 13 Plan filed and files an objection if necessary.
  • Review accounts for potential filing Motion for Relief action.
  • Review Agreed/Consent Order in the event MFR was not granted at hearing.
  • Daily processing and payment reconciliation of payments received on bankruptcy accounts.
  • Send Notice of Default for loans that have failed to comply with Consent Order.
  • Review plans and schedules filed by the debtor, responding to requests from courts and attorneys regarding documentation requirements, and contacting debtor attorney’s regarding the intent of the debtor’s mortgage.
  • Close loans that are no longer in Bankruptcy and the Foreclosure and Loss Mitigation departments.
  • Perform all other duties as assigned.

Qualifications

ESSENTIAL KNOWLEDGE & SKILLS:

  • Strong verbal and written communication skills.
  • Strong math and analytical skills.
  • Detail oriented with the ability to organize and prioritize multiple tasks for efficiency.
  • Ability to multi task and meet critical deadlines while maintaining accuracy and quality.
  • Strong negotiation skills with ability to resolve conflict and resolve problems effectively
  • Ability to make decisions independently within set policy and procedures.

 

EDUCATION AND/OR EXPERIENCE:

 

  • Bachelor’s Degree preferred
  • Minimum four years mortgage servicing experience, strong knowledge of the types of bankruptcy and expertise in how bankruptcy affects a mortgage loan.
  • Minimum two years experience in bankruptcy.

 

 

MACHINES, OFFICE EQUIPMENT & SOFTWARE:

  • Proficient with Microsoft Office applications
  • Familiar with LPS desktop and MSP workstations.
